Part B :       terms and Conditions

 

  1. party

By submitting this lease application (hereinafter referred to as the “Client Agreement”), the applicant applies to operate as a lessee in accordance with the terms and conditions set forth in this document. Upon acceptance of this Client Agreement by 1BIGTeam, (i) the individual identified in this lease application (hereinafter referred to as the “Lessee”) and (ii) 1BIGTeam
A binding contractual relationship between the international companies (hereinafter referred to as "1BIGTeam") comes into effect; collectively referred to as "the Parties".

 

Both parties have agreed to lease the aforementioned equipment in accordance with the following terms and conditions.

2.1 To become a lessee, the applicant should:

a) Complete and submit the rental application.

b) Pay the refundable security deposit, the administrative and network services provided by 1BIGTeam as notified by 1BIGTeam, and the initial and subsequent recurring rental fees required for any official 1BIGTeam document updates. The recurring rental fees shall be payable monthly (“Recurring Fees”) on the date you submit this rental application (Customer Contract).

2.2 The lessee hereby authorizes 1BIGTeam;

a) Collect a refundable security deposit, initial and subsequent recurring rental fees from the lessee's credit or debit card, which is archived in 1BIGTeam or another selected payment method ("Payment Method"); and

b) Automatic collection of each monthly recurring rental payment due under this Customer Contract (billing period is once a month from the date of this Customer Contract or the day preceding it).

c) The Lessee agrees to ensure that the payment method remains valid at all times and will provide 1BIGTeam with all necessary information to allow 1BIGTeam to collect all amounts due from the Lessee. If the payment method expires or becomes invalid for any reason, or if the Lessee fails to pay any fees on time, the Lessee's membership will be suspended, and at 1BIGTeam's option, this Customer Agreement will be terminated, the Lessee will forfeit all rights under this Customer Agreement, and the equipment set will need to be returned directly to 1BIGTeam.

d) Due to time zone differences, the billing date may be one day earlier or later.

e) If the lessee's billing date is not the date of each month (e.g., the 31st), the bill will be issued to the lessee on the last day of that month.

f) If the lessee makes payments to 1BIGTeam through a third party, the lessee's billing date may differ from the supplier's billing date.

In addition to the rental fee, the lessee shall also pay a security deposit of SGD 299 per unit of equipment (SGD 299only) before receiving the equipment and accessories and upon submission of this application, as well as any taxes (if any). This security deposit shall be refunded to the lessee of this rental application and, upon return and inspection, may be used to cover any costs, damage or loss incurred on the rental package (equipment and accessories) according to 1BIGTeam's options.

 

  1. Revise

4.1 1BIGTeam reserves the right to modify all or part of the terms and conditions of the rental packages from time to time by providing notice of such changes in 1BIGTeam’s official documents (including the 1BIGTeam website) or any other mechanism permitted by applicable law.

4.2 1BIGTeam reserves the right to modify/change any monthly rental price/fee and equipment and accessory prices from time to time , provided that 1BIGTeam provides the lessee with a written notice of change at least 30 days prior to the effective date of the change.  

4.3 Unless otherwise provided by applicable law, any modification shall take effect from the date expressly stated in the notice, but not earlier than 30 days after the notice.

  1. Maintenance and operation

The equipment kit (equipment and accessories) may only be used and operated in a prudent and proper manner. Its use must comply with all laws, regulations and rules relating to the ownership, use or maintenance of the equipment and accessories.

  1. Equipment setup conditions

The lessee has inspected the equipment group (equipment and accessories) listed in Part A and confirms that it was in good working order upon receipt of the equipment group.

 

  1. Maintenance, damage and loss

7.1 The Lessee agrees to maintain and keep the equipment group (equipment and accessories) clean and in good working condition at its own expense during the lease term. If any equipment or accessories are lost or damaged beyond repair, the Lessee shall pay the replacement cost of the 1BIGTeam equipment or accessories up to the security deposit. If the cost exceeds the security deposit, the Lessee shall pay an additional 1BIGTeam replacement cost. Please refer to Part A for a replacement cost schedule.

7.2 Damages include:

a) The lessee damaged the equipment set. b) The lessee misused the equipment set, causing a malfunction. c) The lessee attempted to repair the item themselves or had someone else attempt to repair it, damaging it in the process. d) The malfunction was due to wear and tear.

7.3 The lessee shall bear all return shipping costs, including insurance, to cover the risk of loss or damage to equipment or accessories during the return period.

 

  1. 8. Transportation / Logistics

8.1 Shipping costs vary by country/region. It will depend on the logistics costs of the local group.

8.2 1BIGTeam and the lessee shall use the designated group logistics company to handle each shipment.

8.3 Freight costs include freight charges, shipping costs, and insurance for the equipment package.

8.4 All freight costs shall be borne by the Lessee. The Lessee shall pay the freight costs upon applying for this lease, terminating this lease agreement, and confirming the replacement of equipment or parts.

8.5 The lessee shall hand over the leased equipment (equipment and accessories) to the panel logistics company for each shipment.

 

  1. Termination of contract

This lease agreement is billed on a monthly basis. If the termination date of this agreement is less than the commencement date, and after each 30-day period mentioned in the agreement, the remaining days will not be refunded.

 

 

  1. Ownership

The equipment set (equipment and accessories) is and will continue to be the proprietary property of 1BIGTeam.

  1. The entire lease application

This application constitutes the complete understanding of the subject matter contained in this lease application by the parties to this lease application and supersedes any and all other oral or written agreements or arrangements.

  1. Divisibility

If one or more of these terms and conditions are invalid or void, the validity of the remaining terms and conditions shall not be affected, but shall remain in full force and effect.

  1. Parties

By submitting this Application for Membership (hereinafter referred to as “Member Contract”), an applicant applies to operate as a Member on the Terms and Conditions set forth in this document. Upon acceptance of this Member Contract by 1BIGTeam, a binding contractual relationship comes into effect between (i) the individual identified on this Application for Membership (hereinafter referred to as “Member”) and
(ii) 1BIGTeam International as a Pte Ltd (hereinafter referred to as “1BIGTeam”); collectively referred to as the “Parties”.

 

The parties have agreed to use the above-mentioned device set under the following terms and conditions.

  1. Acceptance

2.1 To become a Member, an applicant should;

  1. a) complete, and submit the Application for Membership,
  1. b) pay the Refundable Security Deposit Fee, initial and subsequent recurring Membership fee required as informed by 1BIGTeam for administrative and web services rendered by 1BIGTeam as well as for any official 1BIGTeam literature updates. Recurring Membership Fees are due once a month on the date you submitted this Application for Membership (Member Contract) (“Recurring Fees”).

 

2.2 Member hereby authorize 1BIGTeam to;

  1. a) charge the Refundable Security Deposit Fee, initial and subsequent Recurring Membership Fee to Member's credit or debit card on file with 1BIGTeam or other selected payment method (the “Payment Method”); and
  1. b) automatically charge the Payment Method for each Monthly Recurring Membership Fee payment due (billing cycle is once a month on the date or 1 day before of this Member Contract) and payable under this Member Contract.
  1. c) Member agree to ensure the Payment Method remains valid at all times and will provide to 1BIGTeam all information necessary to allow 1BIGTeam to charge the Payment Method for all amounts due and payable by Member to 1BIGTeam. If the Payment Method expires or becomes invalid for any reason or Member otherwise fail to pay any fees when due, the Member membership will be deactivated, and at the option of 1BIGTeam this Member Contract will terminate, and Member will forfeit all rights under this Member Contract, and the Device Set is needed to return to 1BIGTeam directly.
  1. d) The billing date may be one day earlier or later due to time zone differences.
  1. e) If the day of Member billing date does not occur in every month (for example, the 31 st ), Member will be billed on the last day of that month instead.
  1. f) If Member pay 1BIGTeam through a third party, Member billing date may vary from the provider's billing date.

 

  1. Security Deposit

In addition to the Membership Fee, the Member shall pay a security deposit of SGD299 (Singapore Dollar Two Hundred and Ninety-Nine Only) plus any taxes (if any) per unit of device set prior to receiving the device and accessories, and at the time this Application is submitted. This deposit shall be returned to the Member of this Membership Application, upon return and check subject to the option of 1BIGTeam to apply it against any charges, damages or lost incurred for the Device and accessories within 7 business working days.

 

  1. Modification

4.1 1BIGTeam reserves the full right to modify the terms and conditions of the Member Contract, in whole or in part, from time to time, by providing notice of such changes in official 1BIGTeam literature, including the official 1BIGTeam website, or by any other mechanism permitted under applicable law.

4.2 1BIGTeam reserves the full right to modify/ change any of the monthly Membership set price/fee and device and accessories price, from time to time, provided that 1BIGTeam provides the Member given/ written notice of the change at least 30 days prior to the date the change is to become effective .

4.3 Any modification shall be effective from the date expressed in the notification, but no sooner than 30 days after notification, unless otherwise provided by applicable law.

 

  1. Care and Operation

The Device set (Device and accessories) may only be used and operated in a careful and proper manner. Its use must comply with all laws, ordinances, and regulations relating to the possession, use, or maintenance of the Device and accessories.

 

  1. Condition of Device Set

The Member has inspected the Device set (Device and accessories) listed in Section A and acknowledges it is in good working condition upon receiving of the Device set.

 

  1. Maintenance, Damage and Loss

7.1 The Member agrees to keep and maintain the Device set (Device and accessories) clean and in good working order during the Membership term at his own expense. In the event any Device and accessories is lost or damaged beyond repair, the Member shall pay 1BIGTeam the replacement cost of the device or accessories through the security deposit, and the Member shall additionally pay 1BIGTeam for the replacement cost if which are higher than the security deposit. Please refer to Section A for the replacement cost price list.

7.2 The damages include:

  1. a) The Member had damaged the device set.
    b) The Member had misused the device set and caused the fault.
    c) The Member had tried to repair the item himself or had someone else try to repair it, and in the process damaged it.
    d) The fault is because of wear and tear.

7.3 The Member shall bear all return shipping charges which includes insurance to cover the risk of loss or damage of the Device or accessories during the return.

 

8. Shipping/Logistics

8.1 Shipping cost is vary for each country. It will be according to the local panel logistic fees.

8.2 1BIGTeam and the Member shall use the appointed panel logistics company for every shipment.

8.3 Shipping cost is included the delivery fees and the insurance for the Device set.

8.4 All shipping cost will be bear by the Member. The Member shall pay the shipping cost upon application of this Membership, termination of this Membership contract, and the confirmation of replacement of device or accessories.

8.5 The Member shall drop off the Membership set (Device and accessories) at the panel logistics company for every shipment required.

 

  1. Termination of the Contract

This Membership Contract is all by monthly billing cycle. For Termination of this Contract date is less than the commencement date and every after 30 days term mentioned from the contract, there will be no refund for the remaining days left.

 

  1. Ownership

The Device set (Device and accessories) is and shall remain the exclusive property of 1BIGTeam.

 

  1. Entire Membership Application

This Application constitutes the complete understanding of the parties to this Membership Application regarding the subject matter contained in this Membership Application and supersedes all other agreements or arrangements, either oral or in writing.

 

  1. Severability

If one or more provisions of these Terms and Conditions are or become invalid or void, the validity of the remaining provisions is not thereby affected but remain in full force and effect.
